Gardening and Landscaping Services Award 2020 (MA000101)

The article provides guidelines about when to use the different work types and tags that we includ as part of the pre-built Gardening and Landscaping Services Award 2020 [MA000019] package. Current financial year

August 2023

1st

From 1 August, all employees are entitled to 10 days of paid family and domestic violence leave each year. The (Unpaid) Family and Domestic Violence Leave configuration settings under awards have been updated - the leave category is disabled from award leave allowance templates, and the work type is not enabled automatically for all employees. Please ensure that employees no longer use the unpaid leave category or work type.

July 2023

We have updated the award to reflect the Fair Work Commission’s National Minimum Wage increase detailed in the Annual Wage Review 2022-23 decision and also includes updates to expense-related allowances. You can find information on the Determinations here and here.

These changes come into effect from the first full pay period on or after the 1st July 2023. Please install these updates after you have finalised your last pay run before the first full pay period beginning on or after the 1st July 2023.

Historical financial year

July 2022

We have updated the award to reflect the Fair Work Commission’s National Minimum Wage increase ‌detailed in the Annual Wage Review 2021-22 decision. It also includes updates to expense-related allowances. You can find information on the Determinations ‌here and here. These changes come into effect from the first full pay period on or after 1st July 2022.

Please install these updates after you have finalised your last pay run before the first full pay period beginning on or after 1st July 2022. We have also disabled Unpaid Pandemic Leave as this entitlement has now expired within this award. You can find additional information on the Fairwork website.

January 2022

We have updated the Unpaid Pandemic Leave pay category, and it now counts as service for entitlements under awards and the National Employment Standards. If any staff have used this category previously, please adjust their Annual, Personal, and Long Service Leave balances for any period of unpaid pandemic leave previously taken.

November 2021

We have updated the MA000101 Introductory, Level one, two and three> and MA000101 Level four and five pay condition rule sets to make sure penalties for less than a 10-hour break between shifts, do not apply to leave taken.

We have updated the award in line with the Australian Tax Office (ATO) requirements for Single Touch Payroll (STP) Phase Two reporting. We are now disaggregating the reporting of gross earnings into distinguishable categories. Lastly, we have updated the Pay Category payment classifications in line with the ATO specification categories found here

September 2021

We have added a Meal Allowance work type to this award. You must add the work type ‌to timesheets where you would pay a meal allowance. We have edited the rules about meal allowances in both rulesets to facilitate this change.

August 2021

We have made updates to the Unpaid Pandemic Leave allowance Templates so that the balance displays in weeks instead of hours in line with the Fair Work Commission's guidelines.
Once you install the award, all employees' Unpaid Pandemic leave balances will display in weeks, not hours. It will mean that an employee’s balance may now show as 76 weeks. 

July 2021

We have updated the Employment Agreements for Level four and five Full-time and Part Time employees to apply the pay condition rule set MA000101 Level four and five. We have also updated the Award to reflect the Fair Work Commission’s National Minimum Wage increase of 2.5% detailed in the Annual Wage Review 2020-21 decision. It also includes updates to expense-related allowances. These changes come into effect from the first full pay period on or after 1st July 2021. Please install these updates after you have finalised your last pay run before the first full pay period beginning on or after 1st July 2021.

We have also made updates to the Leave Category Family and Domestic Violence (FDV) Leave, so that the balance displays in days instead of hours in line with the National Employment Standards. Once you install the update, all employees' FDV leave balances will display in days, not hours. It will mean that an employee’s balance may now show as 38 days. 

We have made the following update ‌to make sure that any new installs of this award conducted since 1st July now capture the Super Guarentte (SG) increase from 9.5% to 10% for all pay categories. If you have installed this award between 1st July 2021 to 8th July 2021 for the first time, please make sure you select the No option to the Preserve Custom Pay Categories questions. If you were using this award before 1st July 2021, then you do not need to select the No option. 

February 2021

We have made a correction to the linked pay categories for casuals; and we have now enabled them.

November 2020

We have updated this award, as part of Group Two Awards, to reflect the Fair Work Commission’s National Minimum Wage increase of 1.75% detailed in the Annual Wage Review 2019-20 decision. It also includes updates to expense-related allowances. You can find information on the determinations here and here.

These changes come into effect from the first full pay period on or after 1st November 2020. Please install these updates after you have finalised your last pay run before the first full pay period beginning on or after 1st November 2020.

October 2020

We have updated the Employment Agreements for Apprentices to reflect correct corresponding pay rates based on year of apprenticeship. Please be advised, that if you currently have apprentices employed, check they are employed under the correct year of service once you have installed this update, as this update may change the apprenticeship year for the related employees.

August 2020

We have updated the award to reflect the High Court's decision on the accrual of personal/carer's leave, which overturns the decision made by the Full Federal Court of Australia. With personal/carer's leave calculated on working days, not hours. You can find information on the decision here.

As such, we have removed the Personal/Carer's (10 days) Leave Allowance Templates and updated associated Employment Agreements. Please note, this update will not remove any of the above from a business where you installed the award before 25th August 2020. However, any new award installs from 25th August 2020 will not display personal/carer's (10 days) leave details.

June 2020

We have updated the award pay rate templates to reflect the Australian Taxation Office (ATO) decision to increase the cents per kilometre rate for work-related car expense deductions to 72 cents per kilometre. The new rate applies from the first paid date in the 2020-21 financial year.

April 2020 

We have updated the award to reflect changes made as part of the Fair Work Decision around flexibility during coronavirus. The new schedule allows employees to take up to two weeks of unpaid pandemic leave. We have created a new Unpaid Pandemic Leave Taken, pay category, leave category, and work type.

Also, we have updated the rule sets, where necessary, to include/exclude the work type and leave category to some pay conditions. Furthermore, we have updated the Leave Allowance Templates to make sure we have this new leave category enabled and is now accessible for employees to take this leave when required.

Further, under this new schedule employees can take up to twice as much annual leave at a proportionally reduced rate if their employer agrees. You will need to manually adjust the employee's pay rate and leave balance to half in each pay run for the period of leave.

We have updated the MA000101 Introductory, Level One, Two, and Three, and MA000101 Level Four and Four pay condition rule sets for clause 14 - no meal break. We have also created a new rule for when a meal break has a delay or was not taken, which will then pay at the rate of time and a half until they take a meal break or the shift ends.

We have also added rules for clause 19 - time instead of overtime so an employee can elect to accrue time instead of any payments of overtime. We have also created a new work type and tag called Time in Lieu of Overtime’ that you can apply to these working conditions.

February 2020

Due to recent changes to the interpretation of personal/carer's leave accrual under the National Employment Standards, we have made updates to the setup of the Award. We have created a new Leave Category called Personal/Carer's Ten Days Leave.

Also, we created a Leave Allowance Templates (LATs) Ten Days accrual per year for each state, and we have attached the LATs to the current Employment Agreements. We have updated the rules impacted by Personal/Carer's Leave with the new leave category. 

June 2019

December 2018

We found the setup of the Payroll Tax Exempt field in the Payroll Settings Pay Categories page replicated the Pay as You Go (PAYG) Exempt field rather than creating a unique identity; when installed on your business settings. We have carried out an audit ‌across the platform and have now resolved the issue with this update.

August 2018

We have updated the award to reflect changes made as part of the Fair Work Decision four-year review of modern awards. You can read more information on the determination here. Family and Domestic Violence leave applies from the first full pay period on or after 1st August 2018. You can find further information on the Fair Work site.

Employees, including part-time and casual employees, are entitled to 5 days of unpaid family and domestic violence leave each year of their employment. The five days renew every 12 months of their employment, but it does not accumulate if the leave they do not use the full leave balance.

We have also created a new leave category called Family and Domestic Violence Leave and a new work type called Family and Domestic Violence Leave taken. We have updated the Leave Allowance Templates and any impacted rule conditions.

June 2018

We have updated the award to reflect the Fair Work Commission’s national minimum wage increase of 3.5% from its Annual Wage Review 2017-18 decision. It also includes updates to expense-related allowances. These changes come into effect from the first full pay period on or after 1st July 2018. Please install these updates after you have finalised your last pay run before the first full pay period beginning on or after 1st July 2018.

We have also created ‌new laundry allowance pay categories and rule conditions to reflect the ATO threshold maximum limits for claiming ‌laundry (not dry cleaning) for deductible clothing under the Award. Lastly, we have also updated the Payment Classification settings for Allowance-based pay categories as per STP requirements.

Coverage

The industry award covers employers throughout Australia in the gardening and landscaping services industry. It includes tasks as an example

  • Lawn mowing
  • Design, preparation, and installation of pavements, landscape features, and/or associated lawns and gardens in parklands, public domain, and recreation areas
  • Maintenance or horticultural establishment work following practical completion of work
  • Laying-out, construction, cultivation, or keeping in order gardens concerning private houses
  • Landscape and environmental rehabilitation and restoration works on private or public lands, or
  • Preparation and maintenance of gardens and grounds, including related turf and renovation works in sports fields.

Work types

The following is a list of work types employees can select on their timesheet.

A - F
Annual leave taken. Choose this work type when annual leave is taken.
Call back. Choose this work type where you've gone home for the day and had to be called back to work.
Compassionate leave taken. Choose this work type when compassionate leave is taken.

G - L

Hours worked. Use this work type to represent ordinary hours, unless another work type is more specific.
Hours worked under water restrictions. Use this work type where any local or state legislation prescribes rationing or reducing the usage of water.
Kilometres travelled. >Enter the number of units travelled for business purposes. One unit is equivalent to 1 kilometre.
Leave without pay. Choose this work type when a permanent employee takes leave without pay.
Long service leave. Choose this work type when long service leave is taken.

M-R

Meal allowance. Use this work type when a meal allowance is to be paid.
Paid community service leave taken. Choose this work type when community service leave is taken.
Personal/carer's leave taken. Choose this work type when personal/carers leave was taken.
Public holiday not worked. Use this work type if you are a permanent employee who had a day off work on a public holiday.
RDO taken. Choose this work type when an accumulated RDO day is taken.
S - Z
Time in lieu leave taken. Choose this work type when an accumulated time in lieu is taken.
Time in lieu of overtime. Choose this work type if the employee elects to accrue time in lieu rather than be paid for any overtime.
Travel time using own vehicle. Use this work type to reflect time spent travelling in excess of your normal travel requirements.

Tags

The following tags are available for employees under the Professional Employees Award 2010.

A - F
Drives special vehicle or plant. Choose this tag when the employee is required to drive a work vehicle (which requires a licence for a truck or tractor) or operate a plant in the course of their work (but not when the employee merely assists a fitter or engineer to do such).
First aider. Choose this tag if the employee holds and appropriate first aid qualification and is required to perform first aid duties.
G - L
In charge of 1-2 employees. Choose this tag if the employee is in charge of 1-2 employees.
In charge of 3-6 employees. Choose this tag if the employee is in charge of 3-6 employees.
In charge of 7-9 employees. Choose this tag if the employee is in charge of 7-9 employees.
In charge of 10 or more employees. Choose this tag if the employee is in charge of ten or more employees.
M - R
Provides own tools. Choose this tag if the employee is a tradesperson and is required to provide their own tools as part of their job.
RDO. Choose this tag if the employee should accumulate a daily RDO accrual, based on one day off every four weeks
S - Z
Time in lieu of overtime. Choose this work type if the employee elects to accrue time in lieu rather than be paid for any overtime.
